  • Should I sign a Medical Authorization form for the insurance company?

If you are injured in a car accident and are receiving medical treatment, the at fault insurance company may ask you to sign a medical authorization form so that they may have access to all of your medical records since birth.

Do not sign ANY medical authorization forms from the insurance company.

The insurance company can use this information to deny or reduce your personal injury claim.  Also, if you go to court, the insurance company may try to hire a medical expert that will testify that a pre-existing condition is the cause of your current problem.

If you have been seriously injured in a car accident, you may need a car accident lawyer to get you the medical treatment you need and get your medical bills paid.

  • What are the biggest mistakes made after an accident?

The Biggest Mistakes Made After You are Injured in an Auto Accident include:

    1.  Not being evaluated by EMS if you are injured to any extent.

    2.  Not seeking medical attention at the emergency room immediately after the wreck if you are hurt.

    3.  Not being totally honest with doctors regarding past medical history. Tell them everything!

    4.  Playing tough and not telling troopers, EMS personnel, and doctors each and every location of pain.

    5.  Talking with your doctor about legal stuff, instead of focusing only on the medical part.

    6.  Not keeping all medical appointments. This is very important!

    7.  Only talking about the worse symptoms and keeping quiet regarding other symptoms.

    8.  Not telling doctors about inability or limitation in working and not getting a work release if needed.

    9.  Not doing exactly what the doctor says to do.

    10.  Stopping medical treatment without doctor's consent.

    11.  Not treating emotional injuries if they arise after the accident. Pain and disability can cause depression and anxiety- if you experience these symptoms tell your doctor.

    12.  Not consulting with an experienced personal injury attorney about your case if you are injured. Be totally honest with the attorney concerning the accident, your injuries, and any prior medical problems you had prior to the wreck.

    13.  Thinking insurance adjusters are looking out for you and your family’s best interests.

If you or a loved one are seriously injured by the recklessness of another driver, you may need legal help to get medical treatment and your medical bills paid.

  • Should I give an insurance adjuster a recorded statement?

If you are seriously injured in a car accident and are asked to give a recorded statement to the insurance company, just say no until you have spoken with a car accident lawyer.

Many times, adjusters will ask for a recorded statement while you are still in the hospital on medication or weak from your injuries.

Additionally, if you are unfamiliar with legal terminalogy, you may be asked questions in such a way as to provide a basis for denying your claim.

If you are asked to give a statement, ask the adjuster to show you the at-fault drivers recorded statement first. See if he or she will give you a copy.

If you are uncomfortable talking to the adjustor, call The Derrick Law Firm for a free consultation with a personal injury lawyer.

  • Car Accident: How do I get my medical bills paid?

If you are seriously injured in a car accident and need to seek medical treatment, you will not get your medical bills paid by the at-fault driver's liability policy as they are being incurred. Once you are done seeing doctors, you are able to submit all of your bills to the insurance company to be reimbursed.

This procedure occurs because an insurance company does not have a legal obligation to pay your medical bills as you go.  From a leverage standpoint, the more financial strain you feel from medical bills piling up, the more likely you are to take a quick and low offer to settle your case.

This is one of the reasons why you need PIP (Personal Injury Protection) or Med Pay coverage on your own vehicle insurance policy.

These coverages will reimburse you as you incur the bills up to the PIP or Med Pay policy limits.  It is recommended to file medical bills on your health insurance, Medicare, or Medicaid if you have it to make sure you get the necessary medical treatment.

If you do not get medical attention, even if it is because a lack of money, the insurance company will argue that you were not hurt because of the lack of medical care.

  • What should I tell my doctor about my car wreck?

If you are injured in a car wreck and seek medical care, you should tell your doctor, the truth, the whole truth and nothing but the truth.

Let your doctor know how you were hurt and be completely honest with him regarding your injuries.

    That means:

    1. Tell him about every pain and problem, even if you think it is minor. If you don't report it when it first bothers you, it is hard to get the treatment paid for in the future.
    2. Tell him about your medical history and make sure you let him know of any pre-existing problems you had prior to the wreck. If you don't, the insurance company will argue you tried to mislead your doctor.
    3. Do exactly what he/she tells you to do and make every appointment. If you don't, the insurance company will argue you must not have been hurt because you didn't go to your doctor.

  • Do I trust my adjuster will make the best decision for me?

If you want to know whether your car accident adjustor will make the best decisions for you, ask him/her if he is going to represent you against his company and look after your interests.  Then ask if he will sign a statement you prepare that states the following:

    1. You are innocent of fault and the insurance company admits their insured caused the wreck.
    2. He will certify to you each insurance coverage and the policy limits of each coverage before making you an offer.
    3. He will investigate to make sure there is no other available insurance coverage, including umbrella policies, UIM coverage, and/or PIP or Med Pay coverage.
    4. He will give you a copy of the at-fault party recorded statement before asking for a statement from you.
    5. He will give you a copy of all witnesses' statements.
    6. If you sign a medical release, he will only seek information concerning medical treatment you have received because of this wreck.
    7. He will tell you how much money they have set in "reserve" to pay your claim.
    8. He will give you a copy of all "index"  and financial information they have on you.
    9. He will not be talking to my neighbors, co-workers, and friends to try to dig up trash on you.
    10. He will not have a private investigator follow you around trying to catch you doing something.
    11. He will pay for your medicals and lost wages as they are being incurred to lesson any stress caused by his insured's negligence.

He won't.  His loyalty is with his company, not your health or your livelihood.
