Our client was traveling northbound on SC Highway 327 near Quinby, Florence County, South Carolina. As he approached the intersection of Florence Harlee Boulevard and SC Highway 327, the at-fault driver, traveling southbound on SC Highway 327, attempted to make a left-hand turn onto Florence Harlee Boulevard making our client slam into the trailer.
As our client attempted to cross the intersection, the northbound signal was green. The defendant, driving a Freightliner tractor hauling an enclosed trailer, ignored the yellow flashing arrow facing the southbound turn lane, and failed to yield right of way to our client. As a result, our client who was driving a four-door sedan slammed into the trailer portion of the defendant vehicle. The entire front end of our client’s vehicle was underneath the trailer. He waited thirty-three minutes while rescue crews worked to cut through the wreckage. After being extricated, he was immediately transported by Florence County EMS to McLeod Regional Medical Center Emergency Department with significant facial lacerations and head trauma.
Because of the high medical bills, treatment, and pain and suffering, Injury Lawyer Derrick demanded full policy limits. The insurance argued liability due to the accident report stating our client was at fault for “traveling too fast for conditions”. In an effort to give our client the best result, our Team at The Derrick Law Firm gathered statements from witnesses and a dashcam recording of the accident.
This case went into litigation and settled for $375,000.
