On the night of the accident, along Kings Highway in Myrtle Beach, SC, the at-fault driver aggressively made a left-hand turn in front of oncoming traffic and collided with a car that was traveling north bound.
When an officer arrived at the scene, he determined the at-fault driver caused the accident by failing to yield the right of way and by driving under the influence. The at-fault driver failed field sobriety tests performed at the scene, and he was arrested and taken to the local jail. There, he failed the breathalyzer test showing a Blood Alcohol Content (BAC) of .27, three times the legal limit in South Carolina.
Our client was evaluated by Myrtle Beach Fire and Rescue and complained of pain in his shoulder and leg. He was transferred from the scene by ambulance to Grand Strand Regional Medical Center for a full evaluation. Multiple tests were performed including x-rays of his shoulder and knee. He was fully evaluated and treated at the ER and then discharged with follow up instructions.
Our client continued to experience pain and followed up with a doctor for additional treatment. He complained of on-going, daily pain and was unable to lift his shoulder more than 90 degrees. The doctor stated our client, “clearly has a significant right shoulder injury suggestive of a rotator cuff tear.” The doctor ordered an MRI and sent our client to be evaluated by an orthopedic doctor. Our client told the ortho that he had pain in his right shoulder, right forearm, and right hip. Additional x-rays were taken and a fracture of the pelvis was also discovered. A treatment plan was developed and he was also referred to physical therapy to help relieve some of his pain.
When the treatment plan did not relieve our client’s pain completely, he was provided with additional physical therapy and cortisone injections for his shoulder and hip. Looking to the future, our client will most likely continue to experience pain and may need additional evaluation and treatment. Our client’s medical bills at the time The Derrick Law Firm requested settlement from the insurance company were over $25,000.
In addition to the medical bills, our client had a legal right to be compensated for his pain and suffering as well as punitive damages due from the at-fault driver driving under the influence, being belligerent, and showing no remorse for his actions.
The challenge in this case was that there were four passengers in the hit vehicle who were injured. The at-fault driver had the minimum amount of liability insurance and each person in the car only had access to $12,500 to cover medical bills. The Derrick Law Firm then contacted our client's car insurance company to discuss UIM (underinsured motorist coverage) coverage.
Between the medical damages, pain and suffering, and punitive damages, The Derrick Law Firm settled this case for a total of $100,000, including both the liability and UIM insurance policies.
Myrtle Beach Accident Attorneys at The Derrick Law Firm thoroughly look for every insurance policy available to make sure our client's needs are met after an accident. Cases are investigated and evaluated to obtain the full value of each accident case.
