Apr 18, 2010
In Jackson, Mississippi, a judge has a approved a lawsuit brought forth by a woman who claims she was severely injured when her vehicle was struck by a police officer who ran a red light without his siren on.Joi Fitzgerald, 26, files her complaint against the city of Jackson, claiming that in May of 2007, an officer named Frederick Suttles ran a red light, causing his vehicle to collide with the car Fitzgerald was a passenger in. She is said to have sustained injuries to her neck, right leg, foot, hand and knee, accruing $16,666.16 in medical bills and unspecified lost wages.
Fitzgerald now has to prove that the officer acted in reckless disregard of the wellbeing of a person not engaged in criminal activity at the time she was injured.
In April of last year, a judge in Jackson ruled that a police officer demonstrated reckless disregard for the safety of others, when he caused the death of Desmonde Harris after running a traffic light in his patrol car. A trial date has not yet been set for Fitzgerald's case.
