An experienced attorney will:

  • Be familiar with the Listings and the GRIDS which are two very important parts of the Social Security Disability process that provide what is necessary to prove you are disabled.
  • Know how to maximize your chance of recovery based upon your illnesses, impairments, education, work experience and your residual functional capacity.
  • Request your file from the Social Security Administration, examine it, and then gather additional records, documents and reports prior to the Hearing.
  • Review medical records to determine when the Alleged Onset of Disability (AOD) was claimed. He will see if there is sufficient evidence that you were disabled as of the AOD.
  • Try to establish through past and present records that the disability has continued for the past 12 months.
  • Determine if you need to see a different kind of doctor to prove your case.
  • Make sure the medical records are supplemented by sending questionnaires to your treating physicians to get their opinions on questions which are necessary to prove the disability.
  • Look at your case to determine if your impairment is severe enough to qualify for disability. If so, the attorney will take your case on a contingency bases, meaning he/she will not get paid unless you win.
  • Work with you to ensure you have reported all impairments, both physical and mental.
  • Prepare a pre-hearing brief which sets forth the reasoning your claim should be admitted.
  • Prepare you for the Hearing by explaining procedure and questions you will be asked.
  • Attend the Hearing with you and produce the necessary testimony before the judge.
  • If you are approved, advise you as the the procedure after the award.
  • If you denied, advise you as to whether you should appeal, file a new claim or attempt to go back to work.
  • If an appeal is needed, file it.
