The steps in the Disability application process and what to do if and when your application is denied.
Initial Application
1) The application is filed with the local Social Security Office.
2) The claimant will be asked to file a disability Report and Authorizations to Release Information to the Social Security Association (SSA).
3) The claimant will be asked to fill out a Daily Activities Report and Work History Report.
4) The Claimant will be asked to attend Consultive Examinations by doctors hired by the SSA.
5) If the application is denied, the claimant has 60 days from the date of the denial to appeal the decision.
Request for Reconsideration
You should complete a Request for Reconsideration and an Appeal Disability Report. Both forms can be completed on the internet or on paper at your local Social Security office. Social Security will send your case to the State Disability Determination Services office where your medical records will be reviewed and a new determination will be made about your case. You will be notified in writing of the decision.
If your Request for Reconsideration is denied, the next step is to request a hearing.
Request for a Hearing
Complete a Request for Hearing by Administrative Law Judge and an Appeal Disability Report. Both forms can, again, be completed online or on paper. Once completed, Social Security will send your request to the Office of Disability Adjudication and Review. During this step of the process, you will need legal advice.
A hearing will be scheduled before the Administrative Law Judge. Approximately 30-60 days after the hearing, the judge will notify you in writing of his/her decision.
Appeals Council Review
If a judge rules that you are not disabled, you can request a Review of Decision/Order of Administrative Law Judge. You must sign this on paper and send to your local Social Security Office. Your request will then be sent to the Office of Disability Adjudication and Review. You will be notified in writing of the decision of your case.
District Court Case
If the Appeals Council denies your case, you only other option is to file a case against Social Security in District Court. Your case will be heard by a district court judge who will notify you in writing of the decision on your case. This requires an attorney because very few cases are taken this far and to win at the level you need to show that the Administrative Law Judge made a legal error in the application of law to the facts of your case.
