Mistakes made that could hurt your chances of qualifying for disability

  • Failing to file a claim immediately upon becoming disabled.
  • Failing to obtain legal advice or representation after the denial of the initial claim.
  • Failing to fill out all the paperwork completely for Social Security Disability.
  • Failing to receive medical examinations and treatment consistently from the time the disability begins until it is proven.
  • Failing to follow doctors' recommendations regarding treatment and medications.
  • Failing to have the proper documentation regarding the severity of your illnesses or impairments.
  • Failing to be completely honest in all aspects of the claim including all contact with doctors, Social Security Administration, your own attorney and the Administrative Law Judge.
  • Failing to timely appeal the denial of initial claim or the denial of the reconsideration.
  • Failing to include all impairments whether severe or not; and indicating whether physical or mental in your application.
  • Failing to be completely honest and thorough in your identifying of all your conditions that could affect your ability to work. This includes any history or treatment for depression, mood disorders, memory problems, brain injuries, strokes, etc.
  • Filing a new disability instead of appealing the original claim for disability. Sometimes you can get discouraged by having your claim denied. You should understand that this is very common at the initial level and appeal your claim.
  • Failing to file for the Request for Reconsideration within the time period and if denied at the reconsideration level, failing to file a Request for a Hearing before an Administrative Law Judge.
  • Failing to hire an attorney during the appeals process because you think you cannot afford one. Attorneys are only paid fees if they win.
  • Failing to go to a Social Security Disability medical examination.
